In one of his speeches, prosecutor Emiliano Arias explained that Ezzati was imputed as concealment not only in the case of Muñoz and Laplago, but in a number of cases known as the result of racialism, and he also mentioned an internal violation. The Metropolitan Cathedral, which was not investigated while Ezzati led the Archdiocese: "There are serious and harsh omissions by Mr. Ezzati," he said.
Although he admitted that this was a deformed investigation – and even if it could be weak – judge Eduardo Gallardo said he would expect the murder of still open investigations. Therefore, "in the present state of affairs, I will dismiss my request to Mr Ezze to move in this investigation."
After the resolution, Hugo Rivera's lawyer, questioned the judge's arguments, and assured himself that he would address the Appellate Court to annul the decision. Therefore, before this is resolved, Ezzati will not make a statement to the Prosecutor's Office. "This can not stay on your feet, because the theory supported by the judge is very dangerous, (from which) the person must be formalized and request a final release. Imagine, the innocent should always be formalized with all the consequences," Rivera said.
Meanwhile, prosecutor Emiliano Arias appreciated the decision of the judge and claimed that there was an attempt by the cardinal not to be investigated. "For now there is no background to continue with formalization," the prosecution admitted, but "what is meant here should not be investigated." This is unpleasant. He also appreciated the decision of Juan Carlos Cruz, whistleblower Fernanda Karadime, and one of those who accuse Ezzati for overcrowding. Muñoz continues his nightmare
The situation of Ezzatja was another matter solved by the court, for it first considered the precautionary measures of former chancellor Archbishop Óscar Muñoz Toledo. His defense requested the withdrawal of a night-time detention, which he now fulfills, while the public prosecutor asked for his return to the preventive jail he had in the first months of the trial.
However, Gallardo judge decided to keep him in custody at night, from 22:00 to 18:00, but to add the national roots and ban access to victims.
